A HISTORY OF LAW AND ECONOMICS, 1870 - 1970: PROPERTY, STATE AND THE MARKET

Dina I. Waked Short Abstract

The purpose of this work is to to construct an alternative history of law and economics (L&E). One, that is rid from the mainstream’s allegation that L&E was born in the 1960s to Chicago scholars who revived the interaction between law and economics, which they argue, lay dormant since Bentham writing in 1789. It provides a journey through one hundred years of economic and legal thought, between 1870 and 1970. It highlights how law and economics have continued to interact, to be entangled and to produce a common language. Both legal and economic thought have gone through immense transformations that have shaped their discourses over the years. I have chosen to focus on only three of these transformations, that I refer to as paradigm shifts, that I consider significant to the story I narrate.

Monday, January 28, 2019 6pm Sciences Po Salle François Goguel 27, rue Saint-Guillaume Paris 7ème With Horatia Muir Watt (Sciences Po Law School) BOOK SYNOPSIS The book argues that we live in a world in which the victims of cross-border mass torts de facto lack a court to turn to in order to pursue legal action against multinational corporations responsible for disasters, atrocities, and other harms. And even though tort victims ultimately receive no redress, corporations must nonetheless spend large sums to defend against sprawling, parallel litigations. The only way to provide a fair, legitimate, and efficient process for both victims and corporations is to create an International Court of Civil Justice (ICCJ). The book presents both justice-based and economics-based arguments in favor of an ICCJ. Closely associated with the economic arguments is a broader explanation for why the proposal is not only timely but also, perhaps counterintuitively, politically viable. The book also provides a procedural and institutional design for such a court, addressing such issues as personal and subject-matter jurisdiction, remedies, appeal, preclusion, and judicial independence. BIO Professor Maya Steinitz teaches civil procedure, international arbitration, international business transactions, and corporations. Her research focuses on a wide range of topics including the intersection of civil litigation and corporate law, public and business international law, transnational dispute resolution, and the global legal profession. She has taught courses in comparative law, international law, and international dispute resolution at Harvard Law School, Columbia Law School, Tel Aviv University, and the Hebrew University of Jerusalem. Prior to joining academia she served as a litigator at Latham & Watkins, LLP and Flemming, Zulack & Williamson LLP and clerked for the Hon. Esther Hayut, currently the Chief Justice of the Israeli Supreme Court. Professor Steinitz remains active in international dispute resolution and regularly serves as an arbitrator, expert, and counsel in international and domestic arbitrations. Abstract: Nella nozione di legittimità si nasconde un eccesso di significazione che è stato catturato nella così detta teologia politica. In questo seminario si vuole mettere in discussione tale impostazione, riconsiderando la dimensione politica del sublime, con l’intento di gettare luce sulla attuale "amministrazione della melanconia" che tende ad esprimersi come sovranismo.

P.G. MONATERI è professore ordinario nell'Università di Torino, dove presiede il Corso di Studi in Global Law and Transnational Legal Studies. Presidente onorario della Associazione Italiana di Diritto Comparato, è membro dell'Accademia delle Scienze dell'Istituto di Bologna, della International Academy of Comparative Law di New York e della Société de Législation Comparée di Parigi. È autore di numerose monografie tradotte in varie lingue, tra cui il cinese, e ha recentemente pubblicato "Dominus Mundi. Political Sublime and the World Order", Hart, Oxford, 2018.

Colloque co-organisé par la CNCDH et Sciences Po

A l'occasion des 70 ans de la Déclaration universelle des droits de l'homme, la Commission nationale consultative des droits de l’homme (CNCDH) et Sciences Po souhaitent démontrer la vivacité et l'actualité de ce texte.

Le temps d’un après-midi, ce colloque réunira de grands témoins privés de leurs droits et qui se mobilisent pour qu’ils soient reconnus des membres d’associations qui mènent des actions au nom des droits de l’homme et incarnent ainsi le projet commun de justice toujours vivant au cœur de la DUDH ; des juristes et experts internationaux qui apporteront des éclairages sur les ambitions et la réalité de la Déclaration.

Giornata di studi in onore di Roberto Pardolesi

L’ordinamento giuridico italiano appare attualmente in una fase di profondissima trasformazione. Non a caso la dottrina, da qualche tempo, discute diffusamente di certezza del diritto, prevedibilità dell’esito dei giudizi, oltre che di giustizia, proporzionalità, ragionevolezza ed equità delle soluzioni pretorie. A tutti questi temi, come noto, Roberto Pardolesi ha dedicato, anche di recente, attente riflessioni. Il suo settantesimo compleanno è, dunque, parsa occasione propizia per raccogliere contributi in argomento tra i suoi allievi ed amici e per organizzare una giornata di studi in suo onore, che si propone di contribuire al dibattito in materia e nell’ambito della quale il liber amicorum verrà consegnato al festeggiato.
