SCIENCES COMPORTEMENTALES ET RÉGULATION JURIDIQUE : LE "NUDGING" ENTRE LIBERTARIANISME ET PATERNALISME Séminaire de l'École de droit Olivier De Schutter interviendra sur le thème "Sciences comportementales et régulation juridique : le nudging entre libertarianisme et paternalisme". Discutant : Malik Bozzo-Rey. À partir d’une présentation des acquis des sciences comportementales, développées notamment par les psychologues A. Tversky et D. Kahneman, ainsi que des conséquences qu’en ont tirées pour l’économie et le droit R. Thaler et C. Sunstein, l’on tentera de poser dans ce séminaire la question de savoir si le nudging ne doit pas aller plus loin afin d’inciter les individus à être non seulement réflexifs, mais également autonomes, au sens où l’entendait Castoriadis. Événements 17 septembre 2020 Dès le 24 septembre 2020 LAW, CAPITALISM AND GLOBAL CRISIS: REVISITING THE CANONS The Globinar The idea behind this new Globinar – an online avatar of the traditional “PILAGG” seminar – is to open a discussion on the relationship between law, capitalism and crisis by revisiting various canonical texts, and putting them into perspective or making them dialogue with new ones. The Globinar will run in a book-club format. Three convenors are asked to start a conversation about any one of the chosen texts or other materials, or the relationship between them. An informal discussion will ensue in which the participants will pick up any of these threads. Globinar Series: Thursday Webinar, every two weeks, from September 24th 2020 at 6pm (CEST). Property enhances autonomy for most people, but not for all. Because it both empowers and disables, property requires constant vigilance. A Liberal Theory of Property addresses key questions: how can property be justified? What core values should property law advance, and how do those values interrelate? How is a liberal state obligated to act when shaping property law? Hanoch Dagan is the Stewart and Judy Colton Professor of Legal Theory and Innovation and the Director of the Edmond J. Safra Center for Ethics at Tel-Aviv University. En savoir plus

Comprensibili cause di forza maggiore ci hanno obbligato (come molte altre istituzioni accademiche) a cancellare lo svolgimento in presentia del Colloquio trans-atlantico dei giovani studiosi di diritto comparato, organizzato dall'Associazione Italiana di Diritto Comparato e dallo Younger Comparativists Committee dell'American Society of Comparative Law.

Abbiamo, così, deciso di spostare il Colloquio sul web, trasformando le sue dieci sessioni in altrettanti webinars, che si terranno a partire dal 28 maggio e al 25 giugno p.v.

Alleghiamo, pertanto, la locandina con il programma finale, dove è possibile trovare le informazioni per collegarsi e partecipare ai singoli webinars.

Lancio sito “Comparative COVID Law”

 La Associazione Italiana di Diritto Comparato e Diritto Pubblico Comparato ed Europeo hanno attivato un sito “Comparative Covid Law” [https://comparativecovidlaw.wordpress.com/ ] che intende offrire una prima mappa delle molteplici modifiche normative dettate dalla pandemia di Coronavirus, che riguardano tutti i paesi del mondo, e essere da archivio per presenti e future ricerche. Inoltre il sito cercherà di raccogliere i tanti commenti che sono stati pubblicati o che sono in corso di pubblicazione.

Saremo particolarmente grati a tutti coloro che vorranno segnalare testi normativi o commenti al seguente indirizzo: comparativecovidlaw@gmail.com in modo da poter arricchire in tempi rapidi il sito che è a disposizione di tutta la comunità degli studiosi.
