Professeur Frederick SCHAUER
University of Virginia

             Frederick SCHAUER is David & Mary Harrison Distinguished Professor of Law at the University of Virginia, and was previously Frank Stanton Professor of the First Amendment at Harvard University and Professor of Law at the University of Michigan. He is the author of The Law of Obscenity (BNA, 1976), Free Speech: A Philosophical Enquiry (Cambridge, 1982), Playing By the Rules: A Philosophical Examination of Rule-Based Decision-Making in Law and in Life (Oxford, 1991), Profiles, Probabilities, and Stereotypes (Harvard, 2003), Thinking Like a Lawyer: A New Introduction to Legal Reasoning (Harvard, 2009), and The Force of Law (Harvard, 2015). In addition to being the editor of Karl Llewellyn, The Theory of Rules (Chicago, 2011) he is the author of many articles in legal and philosophical journals on legal theory, constitutional law, constitutional interpretation, legal reasoning, freedom of expression, and the law of evidence and proof.

       Many of the most important questions of legal theory are questions about the sources of law. More particularly, they are questions about what does and does not count as law, and what does and does not count as a legitimate “input” into legal decision-making. This presentation, partly jurisprudential and partly historical, will attempt to locate controversies about legal sources within the theories of many of the major figures in legal theory, and within many of the most important schools of jurisprudential thought.
